Pomerantz LLP filed a class action lawsuit against Nano-X Imaging Ltd. and certain officers, alleging securities law violations between March 31, 2025 and April 17, 2026.
The complaint, filed in the US District Court for the District of New Jersey under docket 26-cv-07062, accuses the company of violating Sections 10(b) and 20(a) of the Securities Exchange Act of 1934 and Rule 10b-5. The lawsuit seeks to recover damages on behalf of investors who purchased Nano-X securities during the class period.
"Investors who purchased Nano-X securities during the Class Period may seek appointment as lead plaintiff," Pomerantz LLP said. The deadline for lead plaintiff motions has not yet been set by the court.
The class period spans more than 12 months, from March 31, 2025 through April 17, 2026. The complaint alleges that Nano-X and certain officers made materially false and misleading statements about the company's business and operations during that time.
Nano-X, which trades on the Nasdaq under the ticker NNOX, develops medical imaging systems based on its proprietary nanotechnology. The company's technology aims to reduce the cost of X-ray devices while improving image quality.
The lawsuit introduces significant legal overhang for Nano-X. A potential settlement or adverse judgment could impose material financial liability on the company, which may also face challenges raising capital while the litigation proceeds. Investors will watch for the company's response and any subsequent court filings.
