Atos SE filed an appeal to contest a $297.9 million judgment awarded to TriZetto, a subsidiary of Cognizant, in a long-running software litigation case.
"This decision does not have a material adverse impact on its assets, business, liquidity or financial condition," Atos said in a statement released May 20.
The final judgment, entered on April 29 by the United States District Court for the Southern District of New York, ordered Atos and its subsidiary Syntel to pay the sum. To obtain a stay of enforcement during the appeal, Atos has implemented a supersedeas bond for the full amount, secured by a $290 million cash deposit. This required an additional $203 million cash deposit on top of funds already held in connection with the litigation.
The appeal, filed May 19 with the U.S. Court of Appeals for the Second Circuit, extends a legal battle over trade secrets that began before Atos acquired Syntel in 2018. A successful appeal would remove a significant liability, while a loss would crystallize the financial impact on the French IT firm.
Breakdown of the Judgment
The total judgment of $297.9 million includes several components outlined in court documents. The court ordered Syntel to pay $69.98 million in compensatory damages and $139.96 million in punitive damages. The award also includes a combined $26.94 million in attorneys' fees and pre-judgment interest calculated at $60.93 million through April 24, 2026, which continues to accrue at a rate of $21,604 per day.
The appeal signals Atos's commitment to fighting the significant financial penalty. Investors will now watch for decisions from the U.S. Court of Appeals, a process that could take several months or longer to resolve.
